Mistral AI is a French company and infrastructure is EU-hosted. La Plateforme (AI Studio) runs in EU. Models also available via Azure, AWS Bedrock, GCP Vertex, and Outscale (French sovereign cloud) for customers needing specific cloud regions.
Paid API and Le Chat Enterprise/Team are opted out of training by default. Free/trial users opted in by default but can opt out. Zero Data Retention available. API inputs/outputs retained up to 30 rolling days for abuse monitoring unless ZDR is active.
DPA explicitly states Mistral AI acts as Processor for commercial API customers and will not use Customer Data for model training for paid/opted-out plans. Fine-tuning data retained until deleted by customer.
Certifications & EU AI Act
Mistral AI has a dedicated AI Governance hub at legal.mistral.ai. Publishes model documentation per Article 53 GPAI requirements. Has signed the EU AI Act Code of Practice. Operates as a Provider under the AI Act and maintains GPAI model documentation for frontier models.
Verification
EU-native company (French SAS, Paris). France is an EU member state — adequacyDecision is true in the sense that no cross-border transfer concern exists for EU customers; SCCs are still used for any non-EU sub-processors. Paid API customers opted out of training by default. ISO 27701 (privacy information management) confirmed. Most proactive EU AI Act posture of any provider in this directory.
